This Privacy Policy is between you and Entrevi Solutions, Inc. (including Via 121, hereinafter referred to as “we”, “us” and “our”). We are a provider of digital marketing services, including opt-in based text message advertising an online ordering (the “Service(s)”), and various websites, including our corporate site, www.entrevi.com, business client and partner sites, and a consumer site where end users can centrally manage their profiles and preferences for using our Services, which are provided to them by our business clients (collectively, the “Website(s)”). This Privacy Policy discloses our privacy practices and governs the use and collection of information collected from all visitors to and users of our Websites and Services. Please read this Privacy Policy carefully to understand our privacy practices. In addition, please review our Website Terms of Use and Terms of Service, which govern your use of this Website and our Services, and which incorporate this Privacy Policy by reference. Your use of this Website and the Services indicates to us that you have read and accept this Privacy Policy. If you do not agree to be bound by all of the terms set forth below, do not use this Website or our Services.

1.    What information do we collect?

        A.    Personally Identifiable Information. Personally Identifiable Information, (hereinafter “PII” or “personal information”) is information about a natural person that is readily identifiable to that specific individual. Personal information includes such things as an individual’s name, address, and phone number. A domain name or Internet Protocol address is not considered personal information. We may ask you to provide us with certain PII so that you can take advantage of certain optional features or functions of the Website. For example, you may be asked to supply your name and email address if you complete the optional registration process for the Website. You can choose not to provide such information, but then you may not be able to take advantage of or participate in some features of the Website. We may combine PII you submit on the Website with information you have otherwise provided to us.

        B.    Non-personally identifiable information. We may also collect non-personally identifiable information from both registered members of and visitors to the Website, including (but not limited to) the following: (i) anonymous demographic information, which is not unique to you, such as your age, gender, merchant relationships, and cause marketing preferences; (ii) information about your computer hardware and software, including your IP address, browser type, domain names, access times and referring website addresses; and (iii) data about which webpages you visit within the Website. We reserve the right to gather additional non-personally identifiable information in the future.

        C.    Children under the age of 13. We do not knowingly collect or solicit PII from or about children under the age of thirteen (13). By submitting any PII, you certify that you are at least 13 years of age. If we discover that we have received any information from or about a child in violation of this section, we will delete that information. If you believe that we have collected PII from or about a child under the age of 13, please contact us at support@entrevi.com.

2.    How do we use PII, and how can you opt out?

        A.    Administrative purposes. We may use PII you submit to contact you for internal administrative purposes such as site administration, troubleshooting, or processing of e-commerce transactions, or relating to your use of the Website or Content you post on the Website, or in our discretion to notify you of major changes to the Website or this Privacy Policy. Automatically collected information (IP address, browser type, domain names, access times, referring website addresses, etc.) is used for the operation of the Service, to maintain quality of the Service and to provide general statistics regarding use of the Website.

B.    Service fulfillment. PII that you voluntarily submit may be used for the purposes authorized when it was submitted. For exampleif you submit PII to request Services, the information that you submit may be used to fulfill your request. If you opt-in to receiving messages from one or more of our business clients, we may provide your unique PII to the specific business customer(s) to whom you gave explicit permission by opting-in. We may share your PII with third parties who provide customer or operational support for the Website or features thereof (including statistical analysis), or who send you email or postal mail or arrange for deliveries on our behalf.

C.    Communications. We may use your PII to contact you as follows:

i.      If you opt-in to receiving messages from one or more of our business clients, we may send you communications on their behalf;

ii.     If you subscribe to our Services, we may send you special offers and informational about our other products or services and surveys about our current or potential service offerings, if you have not opted out of receiving such information and offers; and

iii.    If you subscribe to our Services, we may contact you on behalf of third-party business partners about offerings that may be of interest to you, and your PII may be transferred to such third parties, unless you choose to opt out of receiving such communications.

D.    Opt-out and unsubscribe. We respect your privacy and provide you with several ways to opt-out of receiving communications, including:

i.     Text messages. You may opt-out of receiving any or all text message communications sent to you by us on behalf of our business clients by replying “STOP” to any such text message. If you opt-out of one of our business clients’ loyalty and special promotions programs, we will use reasonable efforts to ensure that we send no further messages to your phone number on behalf of that particular business client more than ten (10) business days after our receipt of your request.  

ii.    Email. If you do not wish to receive informational emails from us about special offers and other products or services available from us and from our business clients and third party marketing partners, you may follow the instructions for unsubscribing included within any such emails.

iii.   Account preferences. if you have a user account on our Website, you can manage your communication preferences by logging in, clicking on your username and then clicking on “Settings.”

Certain communications, including administrative, service-related messages and certain messages related to charitable giving are not optional, and you cannot opt-out of receiving such communications.

3.    How do we collect and use non-personally identifying information? We may collect and use non-personal information in order to facilitate Website use, customize content advertising within the Website, and create aggregate statistics about Website activity, as follows:

A.    Log files. We may track and collect information about browser types, Internet service providers (ISPs), referring/exit pages, platform types, date/time stamps, number of clicks, and Internet protocol (IP) addresses. We may use IP addresses for a number of purposes, such as system administration, to report aggregate information to our business clients and partners, or to audit the use of the Website.

B.    Cookies. We may use browser “cookies” to collect data about which webpages you visit within the Website in order to deliver customized content and advertising within the Website and measure interest in our Services. A “cookie” is a small piece of information in the form of a text file that is placed on your hard disk by a web page server and assigns a unique, random numerical identification code to you, which can only be read by a web server in the domain that issued the cookie to you. We may use cookies and the data collected therefrom to facilitate easy login (i.e., recognize your browser when you return to the Website); to simplify Website navigation; to record and recall your payment information, billing/shipping information and preferences on subsequent visits; to help serve advertisements and offers and sequence ads in a series (to ensure that your browser does or does not see the same more than once), and to otherwise to personalize your online experience, and to track page usage and paths. You have the ability to accept or decline cookies. Most Web browsers accept cookies by default, but you can usually modify your browser settings or preferences to decline or refuse all cookies or to indicate when a cookie is being set. If you choose to decline or disable cookies, you may not be able to fully experience certain interactive features of our Website or Services. Our cookies do not automatically collect PII, however, we may link the cookie to PII you submit or other information we collect.

4.    How do we use aggregated data? We collect and maintain data aggregated from across all our Website users and Service customers, and we use such aggregated data for statistical analysis and service fulfillment. For example, we may use aggregated data to describe our services and improve our marketing strategy, Website design, user experience and service offerings. We may also use aggregated data to develop and provide data analytics services to our business clients and partners, for example, to measure activity on the Website and gauge interest in various areas of the Website by measuring the number of unique visitors that visit a particular webpage, or how much time is spent on each page of the Website and the number of return visits to the Website, or to create aggregate demographic statistics about our users. We aggregate and maintain PII (including the phone numbers, transaction histories, and other user-provided data) of users who have both opted-in and opted-out of our business clients’ loyalty programs, and we use such data to make it easier for users who have opted-in to use the loyalty programs of multiple businesses customers, or, for users who have opted-out, to later opt-in again without losing their user history and status. We may disclose aggregate data to third parties, however, we will not provide or disclose PII from our aggregated data to third parties, except as provided in this Privacy Policy. If you would like us to permanently delete all data associated with your phone number or email address, you can email support@entrevi.com and include verification that the number or email address is yours.  We will call and/or send text to the phone number or email the email address in order to verify the request, and delete your PII from our database as soon as reasonably possible in accordance with applicable law.

 5.    Is your personal information protected?  We use reasonable administrative, technical, personnel and physical measures to safeguard PII against loss, theft and unauthorized use, disclosure or modification. When PII (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol. As effective as our security measures are, no security system is impenetrable. PII may be stored on computers of third parties that provide technical support for the operation of the Website or otherwise have access to your PII as disclosed in this Privacy Policy. We do not control the security measures used by such third parties. Our Website may contain links to third-party websites. We are not responsible for the privacy policies or other content on any third party websites outside of our Website, or the security measures used by such third parties. It is your responsibility to review the privacy policies of such websites to understand how they collect, use and share your information.

 6.    Third party advertisements. We may use third party companies to serve advertisements on the Website. These companies may use cookies, web beacons or other tracking mechanisms to collect non-personally identifiable information about your visits to this Website and other websites, so that they can measure the effectiveness of ads, and to track page usage and paths followed during visits. These companies may provide this data to us.

7.    Connecting your Entrevi account to third party accounts. By connecting your user account to any third party account, such as a Facebook account, you acknowledge and agree that you are consenting to the continuous release of information about you to others in accordance with your privacy settings on those third party sites. If you do not want information about you (including your PII) shared in this manner, do not use this feature. You may disconnect your account from a third party account at any time. For example, you may remove or change permissions to the our Facebook applications from the Facebook Application Settings page.

8.    Disclosures required by law.  As described in this Privacy Policy, certain uses of collected information may involve disclosure to third parties. In addition, we may disclose collected information in the good faith belief that we are required to do so by law, or when doing so is reasonably necessary to: (i) conform to the edicts of the law or comply with legal process served on us or the Website; (ii) respond to any claims; (iii) protect and defend our rights and property; (iv) act under exigent circumstances to protect the personal safety of our employees and those of our marketing partners, as well as our customers, users or the public; or (iv) protect against misuse or unauthorized use of the Website. In addition, collected information may be disclosed as part of any bankruptcy, merger, sale, transfer of company assets or acquisition.

9.    Changes to this Privacy Policy. This Privacy Policy may be modified from time to time and at any time. The date of the most recent revision will appear on this page. You agree that your use of the Website or the Service is subject to this Privacy Policy as then in effect, and your continued use of the Website or the Service following any modification in this Privacy Policy will constitute your acceptance of this Privacy Policy as modified.

10.  California residents. Users of the Website who are California residents and who have provided PII to us may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to support@entrevi.com  with “Request for California Privacy Information” in the subject line and in the message.
